Terms and Conditions

These Terms and Conditions apply when you order products from Aeros Pty Ltd through the Aeros website. Please read them before placing an order.

1. About Aeros

In these Terms:

  • Aeros, we, us and our mean Aeros Pty Ltd (ABN 55 102 859 978).
  • You and your mean the person or organisation placing the order.
  • Website means the authorised Aeros website through which the order is placed.
  • Products include Aeros shower cubicles, parts and accessories sold by us.

2. Agreement to these Terms

By submitting an order, you offer to purchase the products in your order under these Terms. You must also review any product information, delivery information and policies linked at checkout.

If you place an order for another person or organisation, you confirm that you are authorised to do so and that the recipient has received all information relevant to delivery, inspection, installation and use.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

3. Product information and suitability

We take reasonable care to describe products accurately. Images may show accessories, surrounding fittings or installation examples that are not included unless the product description expressly states they are included. Colours and finishes may appear differently because of lighting, photography and screen settings.

Before ordering, you are responsible for checking the selected model, size, colour, configuration and quantity; available installation space, access route and minimum required clearances; relevant plumbing, drainage, electrical and structural requirements; that the delivery address and site can safely receive the packaged product; and whether professional advice or licensed trade work is required.

If you tell us the particular purpose for which you need a product, we will take reasonable care when responding. General website information is not a substitute for advice from an appropriately qualified tradesperson about your specific installation site.

Safety glass must not be drilled, cut or otherwise altered after tempering.

4. Prices, GST and freight

Unless clearly stated otherwise, prices displayed to Australian customers are in Australian dollars and include GST.

Freight charges depend on the products ordered, destination, address type and delivery method. The applicable freight charge must be calculated or confirmed before your order is finalised.

If the website cannot provide freight for your destination, you must contact Aeros for a freight quotation. Do not complete payment on the assumption that delivery is included.

If a displayed price, freight charge or product description contains an obvious error, we may contact you before accepting the order to confirm the correct information. You may proceed on the corrected basis or cancel the affected order and receive a full refund of any amount already paid for it.

5. Placing and accepting orders

Submitting an order and receiving an automated acknowledgement do not by themselves mean Aeros has accepted the order. Acceptance occurs when we confirm that the order has been accepted or dispatch the products, whichever occurs first.

We may decline an order before acceptance where a product is unavailable, payment cannot be authorised or verified, freight service or delivery address cannot be confirmed, there is an obvious pricing or product-information error, we reasonably suspect fraud or unauthorised activity, or accepting the order would breach a law.

If we decline an order after receiving payment, we will refund the amount paid for the declined order.

6. Payment

You must pay the product price, applicable freight charges and any other amount clearly disclosed before placing the order.

Payment is subject to the conditions and security checks of the payment provider you select. We may delay processing until cleared payment or payment authorisation is received.

Any payment surcharge will be disclosed before payment and will not exceed the amount permitted by law.

7. Changes and cancellations before dispatch

Contact Aeros promptly if you need to change or cancel an order. A requested change or cancellation does not take effect until Aeros confirms it.

  • There is no cancellation charge if Aeros has not commenced processing the order.
  • A $45 cancellation charge applies if the order has been prepared and is ready for dispatch but is still awaiting collection by the freight carrier.

If the order has already been collected or dispatched, it cannot be treated as a cancellation before dispatch. Any approved return will instead be handled under the applicable returns provisions in these Terms.

The cancellation charge does not apply where Aeros cancels the order or where the customer is entitled to cancel or obtain another remedy under the Australian Consumer Law.

8. Delivery within Australia

We deliver shower cubicles and replacement parts throughout Australia, subject to available freight services and a confirmed freight charge.

Depending on the destination, delivery may be available to a residential address, a suitable business address or a freight-company depot for collection. Where door-to-door delivery is unavailable, delivery may need to be made to the nearest suitable freight depot.

Unless Aeros confirms otherwise in writing, shower-cubicle delivery is a kerbside delivery service performed by a single driver. Kerbside delivery does not include taking products inside a building, upstairs, behind a gate or to another location within the property.

You are responsible for making suitable arrangements to move the products from the kerbside delivery point after delivery.

Trade and business delivery locations must have a suitable forklift available on site to unload shower cubicles and other palletised freight safely. Manual unloading of palletised shower-cubicle freight is not permitted under the applicable OH&S requirements. If a suitable forklift is not available, a tailgate delivery service must be arranged and the applicable tailgate charge will be added to the invoice.

Domestic Australian orders are normally processed within 2–5 business days after payment has been authorised and verified. Delivery within Australia generally takes approximately 2–14 business days after processing.

These are estimates, not guaranteed delivery dates. Remote destinations, residential deliveries, weather, public holidays, carrier operations and access conditions may cause delays.

Products or parts may arrive in separate consignments. All standard domestic Australian freight deliveries include tracking or consignment information.

9. Delivery address, access and receipt

You must provide an accurate delivery name, address, postcode, telephone number and relevant access information and tell us before dispatch about conditions that may affect delivery.

A person authorised by you must be present to receive and sign for every delivery unless authority to leave has been approved before delivery. Shower cubicles are bulky freight and may arrive on two pallets.

Products will not be left unattended unless Aeros or the freight carrier has provided prior authority to leave them in a safe and readily accessible location. The driver retains discretion to refuse to leave a delivery if the proposed location is unsafe, unsuitable or not readily accessible.

If authority to leave is requested or accepted, no recipient signature will be obtained and visible damage cannot be recorded on a signed delivery receipt. This may affect the availability of transit-insurance coverage but does not exclude rights under the Australian Consumer Law.

Reasonable additional freight, storage, redelivery or depot charges may be added to the invoice where costs arise because delivery information was incorrect or incomplete, nobody was available when attendance was required, access restrictions were not disclosed, or suitable unloading facilities were unavailable.

10. Inspecting deliveries and transit damage

Please inspect all packages and components promptly and, where practical, before installation.

Aeros asks customers to report visible transit damage, missing packages or missing components within 14 days of receiving or collecting an order so we can investigate promptly with the freight company.

Before signing for delivery, inspect the external condition of the freight and packaging. Any visible loss or damage must be clearly recorded on the delivery receipt or electronic proof of delivery before you sign.

If you discover damage, stop unpacking or installing the affected component if continuing may cause further damage, keep the component and packaging, photograph the packaging, freight label and affected component, and contact Aeros with your order details and photographs.

The 14-day reporting request helps us investigate transit claims. It does not remove or reduce any rights under the Australian Consumer Law.

11. Check the order before arranging tradespeople

Before arranging or booking any tradesperson, unpack and inspect the product and confirm that the correct product and all required components have been delivered, nothing is missing, damaged or incorrect, any required replacement parts have been received, and the product is suitable and ready for installation.

Aeros does not compensate for tradesperson fees, call-out charges, waiting time, lost time or other additional costs incurred because a product is delayed, incomplete or damaged, or because replacement parts are required, where tradespeople were arranged before these checks were completed.

Nothing in this section excludes any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

12. Returns and change of mind

You are not automatically entitled to a refund or exchange because you changed your mind, ordered the wrong model or size, found the product elsewhere for less or no longer require the product.

Aeros may accept a change-of-mind return at its discretion if you contact us within 14 days of receipt and the product is unused, unopened, undamaged, in its original packaging and accompanied by proof of purchase.

For an approved change-of-mind return, you are responsible for return freight and the product until Aeros receives it. Original and return freight charges are not refundable, and a 20% restocking fee may be deducted from the refund.

These conditions do not apply to a remedy required under the Australian Consumer Law. Do not return bulky products without first receiving return instructions from Aeros.

13. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

If a product does not meet an applicable consumer guarantee, the remedy will depend on the circumstances, the seriousness of the problem and whether it can be remedied within a reasonable time. Aeros may assess the product before providing a remedy.

Where required by law, Aeros will reimburse reasonable return costs for products that can be posted or easily returned. For a large, heavy, installed or otherwise difficult-to-return product, contact Aeros so an appropriate inspection, collection or other remedy can be arranged.

Proof of purchase may be requested.

14. Aeros product warranty

In addition to your rights under the Australian Consumer Law, Aeros shower cubicles are currently supported by:

  • A 5-year warranty on tapware.
  • A 3-year warranty on all other parts, including bases, panels, frames and glass.

Warranty information and claim instructions are provided on the Aeros Registration and Warranty page. Please retain proof of purchase.

Any Aeros warranty is in addition to—and does not replace or limit—your rights and remedies under the Australian Consumer Law.

15. Installation and use

Products must be assembled, installed, connected, maintained and used in accordance with the supplied instructions, applicable laws and Australian requirements, and the requirements of qualified or licensed trades where applicable.

Before installation, check that the delivered model and components match the order and are suitable for the site. Do not install a component that appears damaged, incorrect or unsafe.

Aeros is not responsible for loss caused solely by installation, alteration, misuse, neglect or maintenance contrary to the supplied instructions or applicable requirements. This does not limit responsibility for a product defect, incorrect information supplied by Aeros, or any right or remedy that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by law, Aeros is not liable for indirect or consequential loss that was not reasonably foreseeable or for loss caused by failure to follow reasonable product, installation, safety, delivery or care instructions.

Nothing in these Terms excludes, restricts or modifies the Australian Consumer Law or any other right or remedy that cannot lawfully be excluded.

17. Privacy

We handle personal information in accordance with our Privacy Policy.

We may provide information reasonably required to payment providers, freight companies and service providers to process payments, deliver orders, prevent fraud and provide customer support.

18. International orders

International shipping is available by quotation. International orders are office-arranged and cannot be completed through the standard Australian website checkout.

Please contact Aeros to confirm product availability, pricing, freight, processing and delivery lead times before placing an international order.

19. Website availability and intellectual property

We may update, suspend or withdraw website features where reasonably necessary. Website content, branding, photographs, graphics and product information owned by Aeros are protected by intellectual-property laws.

You may use the website for personal or internal business purchasing purposes. You must not reproduce or commercially exploit Aeros content without permission, except as permitted by law.

20. Changes to these Terms

We may update these Terms from time to time. The Terms displayed and accepted when you place an order will apply to that order unless we and you agree otherwise or a change is required by law.

21. Severability

If any provision of these Terms is unlawful, void or unenforceable, it will be read down to the extent necessary or severed. The remaining provisions will continue to operate.

22. Governing law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals that have jurisdiction under applicable law. This does not prevent a consumer from exercising any right available under applicable consumer law.

23. Trade and business customers

Unless Aeros and a trade or business customer agree to separate written trading terms, these Terms also apply to orders placed by trade and business customers.

Trade and business delivery locations must have a suitable forklift available on site for unloading palletised freight. Manual unloading of palletised shower-cubicle freight is not permitted under the applicable OH&S requirements. If a suitable forklift is not available, a tailgate delivery service must be arranged and the applicable tailgate charge will be added to the invoice.

Nothing in these Terms excludes, restricts or modifies any protection applying to a small-business contract or any other right or remedy that cannot lawfully be excluded.
